Owning, Renting or Sharing – What Are My Rights & How to Create A Land-Share Agreement.

Our planet Earth, is the only planet known to create & sustain life – in the entire universe!  By birth, it’s mine & yours.  But I don’t own it & can’t live on it – I don’t have the right to, unless I buy it.  But what if I can’t afford it?

We are all fast observing the destructive nature of the consumeristic “own everything” mentality, with the globally fashionable “American Dream” having developed into a nightmare scenario [2] and a major driver of climate change.  Everyone wants to own their own land.  But is real-estate consuming the right to live – does it force a price on life?  Can I afford it?

These are the kinds of questions I’ve been asking myself, as I attempt to understand property rights and agreements.

The University of Leeds [1] “Environmental Challenges: Hierarchy in Property Rights” is helping me – this is what I have learnt so far…


Traditionally, there are two major perceptions of nature:

  1. Hunter-gatherer.
  2. Agriculturalists.

Hunter-gatherer mentality is that nature is a generous and giving parent who provides abundantly.  Thus, sharing is their natural way of behaving.  They share & exchange with the group for mutual benefit, and do not need security as they have so much.

Agriculturalist mentality is that nature is a controlling ancestor who when displeased, may take away.  They grow & trade for money or goods and find security through saving excess.

The wild tree that bears fruit does not expect a return for sharing with the gatherer.  If humans are an integral part of nature – then they are one with the tree – and the one who harvests should not expect a return either.  However, the ‘tragedy of the commons’ is that without some restrictions, over-use goes unchecked & the incentive is to gather in such a way that maximizes personal gain.  This can lead to over harvesting/grazing.  The idea behind property rights, is that it will control over grazing/harvesting.

However, this prevents the common right to wild species.  In Finland, there is “every man’s right” to pick wild species, if they are not protected.  Generally, true ‘open access’ does not exist as there is always some form of regulation.  In Finland, this is a social expectation that people will respect nature & other’s enjoyment of it.

Lastly, it can be said that it may be natural to over-graze, nature is dynamic and who are we to define what is and is not natural.  After all, people are part of nature too.

Sometimes, it can appear that land is managed better via property ownership.  However, in reality – nature is highly abundant & diverse for many species (not just humans).  What can appear as better management practices is often selective growth to suit human needs.  The key to remedying this, is to ensure land clearing for human centric species does not occur.  If human centric species are required, these should be integrated into the existing environment.  Thus, there is no decrease in natural abundance – but an increase, to cater better for human needs.

We can see that the traditional perceptions of nature (hunter-gatherer & agriculturalist) no longer fit.  A new perception (along with a language to describe it) needs to be developed to understand the best way to manage land.


Standing on an ocean cliff enjoying the wind may or may not bring you to feel you own it – however enjoying the birds & flowers in your backyard through legal structures, does provide a sense of ownership.  Between that ocean & your backyard there are many natural environments – do people wish to own them?  Who?

It is commonly believed that an agricultural society needs property rights & these are often divided into 4 types of rights:

  • Open access – is said to lead to the tragedy of the commons (where over-exploitation degrades the land) however this is from the agriculturalist view-point. The hunter-gatherer viewpoint does not think in term of property rights at all & does not lead to degradation.
  • Communal – rights are controlled by a shared (communal) set of rules.
  • Private – one individual who has the only access (thus can preserve or destroy at will).
  • State – rights are the government having the rights.

Humans (like life) can enter into complex social arrangements.  Nobel Prize winner Elinor Ostrom (American political economist) has defined the following five rights for access & extraction of natural resources:

  • Access – the right to enter a specified property.
  • Withdrawal – the right to harvest specific products.
  • Management – the right to transform the resource & regulate internal use of patterns.
  • Exclusion – the right to decide who will have access, withdrawal & management rights.
  • Alienation – the right to lease or sell any of the four rights.

These rights can be bundled into different combinations – into a hierarchy of property rights.  An owner* would have all five rights.  A proprietor* would not have alienation rights.  A claimant access, withdrawal & management…and so on as shown below:

*  Owner and proprietor are often used interchangeably, however it is now evident that there is a difference in meaning.  This description explains that difference.


Ostrom also investigated the rules & agreements which give rise to good property rights & management systems:

  • Clear, well understood boundaries.
  • Appropriate rules (which fit with local, social & environmental conditions).
  • Democratic rights:
    • people affected by the rules can participate in the discussions that might change them.
    • rights to make their own rules.
  • Monitoring of resource condition (by the users or people accountable to the users).
  • Graduated sanctions for (a range of) infringements.
  • Effective conflict resolution mechanisms.
  • Nested enterprises where the natural resource is part of a larger social ecological system.

Due to such high diversity, Ostrom has defined the core goal of public policy to be:

…to facilitate the development of institutions that bring out the best in humans.

And the most important aspect of it all, to be:

                …to communicate (which requires the right language).

Garett Hardin’s essay ‘The Tragedy of the Commons.’ discusses the contrast between social & technical solutions.  Here are notes from listening to a podcast about this topic:

  • Property rights (with well-defined boundaries) work well in a predictable climate (where the environment does not change) …but not so well in an unpredictable environment (where after a short time, the defined boundaries may need amendment). Thus, communal management is more suited to an unpredictable environment as it can easily be modified as needed by the local community.
  • With a dynamic environment, you need a dynamic management system (which a local or communal system can deliver).
  • A story to explain the issues of ownership…. A village watched a road built & were worried it would bring war. It brought a wealthy old man who built a villa & a public bath at the village spring (which was also on his land).  For years people enjoyed the bath & drank from the spring.  The man died & his son turned it into a hotel.  A wall was built around the spring, restricting who could access it.  The village spring was now privatized.
  • The real tragedy of the commons, is when ecological nodes (such as water sources) become private property. This is how suffering occurs in dynamic environments (such as in Africa).



Question:            Can we retain biodiversity AND have an equitable distribution of resources (particularly for local people)?

Several models and theories explain the effect of population on land.  Generally, an increase in population causes:

More people, less land + Privatized property = Look after land better + crops improve

In some locations this may be true.  However, often (an increasingly so) – this model does not fit.  A more accurate model would be:

More people, less land + Privatized property = Look after land worse + monoculture crops improve

This is driven by:

  • Loss of species rich agriculture through the intensification of farming high yielding crop & animal varieties (i.e. monoculture).
  • Inorganic fertilizers.
  • Pesticides & herbicides.
  • Changes in land tenure from communal to private.
  • Globalization of food supply chains.


What contribution can plant & animal diversity make to feeding the world?


Diversity is achieved through…

  1. Small-holder farming (which use local plant & animal species).
  2. Urban farming (naturally diverse due to personal choice).

Diversity leads to….

Social resilience through:

  • Higher crop diversity means more skills needed = skill sharing within the community.
  • Land ownership stays in the community bringing local benefits.
  • Diet is healthier.
  • Greater communication & sharing on a local scale.
  • Ecological knowledge is kept alive.

Environmental resilience through:

  • Diversity.
  • Non-food species (fuel & materials) stops erosion.
  • Respect for the environment.

Why doesn’t this occur?

  • Ownership of large amounts of land lead to profits for a few.
  • Landownership generates political power.
  • With political power, influence to change laws and favour large landowners occurs.
  • Researched focused on a single variety can reap returns when it is planted on large scale.
  • Large fields mean reliance on mechanism and avoidance of having to bother with a labour force.

So how can we encourage a better way:

  • Do not ignore the differences (keep it real).
  • Develop institutions that bring out the best in humans.

Biodiversity loss (& through this, biodiversity conservation) is one of the most important & controversial issues of the current era.  A large proportion of land has been converted into agriculture, managed forests & urban landscapes.  A recent study has found that biodiversity conservation must occur on managed human-dominated ecosystems.  We should enhance biodiversity through our management.

The term biodiversity can mean two things – genetic diversity or functional diversity.  Measuring genetic diversity does not always work – as bias towards ‘cute’ or attractive species means the others are omitted.  Before we look at functional diversity, what is it?  It is looking at a species’ function.  For example, one species may be the basis for a whole range of others, while another does not (it is functionally redundant).  Thus, some species play a more important role.  This is what holds the balance of nature in place.  Thus, we are focusing on the biological integrity of the system.  This is where trophic level (food web) analysis comes into play.  Functional diversity may be interpreted as the number of species required for a given ecological process.  For this to occur, the ‘keystone role’ of a species needs to be identified.  Thus, we may identify groups of significant species.  In addition to this, we must understand how to manage a landscape as some species require a disturbance to thrive.  We can maximize biodiversity through supporting a dynamic landscape, while at the same time allowing for low-intensity use (thus the environment looks after itself).  Thus, biological resources in low-intensively managed environments maximizes our economy through biodiversity.

Economic values in managed landscapes:


Prediction of the neo-Malthusians is that population will outstrip the supply of food & other key natural resources.  The subsequent famine & disease will limit the population.  There will be wars due to competition for the ever-decreasing resources.  Before this happens, the world will have been transformed into a different place by human domination & overexploitation of natural resources.

But there is a light at the end of the tunnel – another way.  Increasing population results in better natural resource management.  Thus, the land & oceans can be used to their best advantage.


  • Be careful about the resources you use.
  • Do not waste food.
  • Recycle.
  • Use farmed resources (managed) over wild – to prevent the tragedy of the commons.
  • Land cared for by many small holders, rather than a few farmers with enormous land holdings & mechanised operations.
  • Use biodiverse, organic cropping systems.
  • Educate, equalize & provide employment security to women (to stabilize birth rates).
  • Live in harmony with nature.

Humans are self-regulating.  An increase in population leads to:

  • Better education.
  • Economic prosperity.
  • Lower birth rates.
  • Population stabilization.

Douglass North (Nobel Prize winner) calls property rights – institutions.  He describes these institutions as ‘the humanly devised constraints that structure human interaction’ & said that they are made up of:

  1. Formal constraints (rules, laws, constitutions etc).
  2. Informal constraints (norms of behaviour, conventions, self-imposed codes of conduct).


Understanding local language is the key to understanding property rights.  Many languages centre around the natural environment.  Thus, when the natural environment is lost – so too is language and following this, relationships – as people no longer share the same experiences.

There are two language issues which result & need to be accounted for (and thus managed):

  1. Translation – what does a person mean when they describe the environment or its use. You must be sure to understand a person’s language or interpretation.
  2. In evolution of language over time – meaning at one point in time may evolve into something different at a later stage. Account for this using language or revision at a later date to ensure accuracy is upheld.

Just remember….” Until the lions have their own historians, the history of the hunt will always glorify the hunter.” (Chinua Achebe).

Alternative to official property rights:

Usufruct property rights – not formally recognised. People within the community know who owns what and who has access rights or extraction rights from different parts of the natural system, but it’s not legally codified (but through a system of social contracts, and social obligations, and social responsibilities).  If these rights are lost, it can lead to loss of access to resources, alienation or displacement.


Permaculturalists attempt to move back to the abundance of the hunter-gatherer days, through agroecology.  This is, an agricultural & horticultural environment which mimics a natural system.

Here are some points to ponder – using directives on how to write a policy brief.  Using this method will help you think outside the box and identify a variety of opportunities available to you.  If you are writing the agreement yourself – this is worth doing, especially if the property is unchartered!

Be knowledgeable & professional.

A brief must be concise & accurate:

  1. Cover the problem.
  2. Offer options.

The brief should contain:

  1. The issue. What is the proposition about?  What decision needs to be made?
  2. Timing – how urgent the decision is.
  3. Background that is needed to make the decision – what is the objective?
  4. Realistic options.
  5. Recommendations by yourself.
  6. Agreed & dissenting views – what do others think?
  7. Implications – cost, time, personnel, items needed etc.
  8. Risk & mitigation.
  9. Implications for others.
